1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "Customer") and Mobile Flow Ltd ("we," "us," or "usfax.com") governing your access to and use of the usfax.com website and all related services, features, and applications (collectively, the "Service"). By creating an account or using the Service in any way, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Description of Service

usfax.com is an online fax service that allows you to send and receive faxes through a web-based interface, email, or other supported methods. The Service includes the ability to obtain a dedicated fax number, send documents as faxes, receive faxes as digital documents, and manage fax history.

3. Eligibility and Account Registration

You must be at least 18 years old and have the legal capacity to enter into a binding agreement to use the Service. When you register, you agree to provide accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

4. Subscription Plans and Billing

The Service is offered through various subscription plans with different features and page allowances. Subscriptions renew automatically unless you cancel before the renewal date. Price changes take effect at the start of your next billing cycle with 30 days advance notice. All prices are exclusive of applicable taxes.

5. Free Trial

We offer a free trial period for new users. If you do not subscribe to a paid plan before the trial ends, your access to trial features will expire.

6. Cancellation and Refunds

You may cancel your subscription at any time from your account settings. Your subscription remains active until the end of the current paid billing period. If not satisfied, you may request a full refund within 14 days of your initial purchase or renewal by contacting support@usfax.com.

7. Acceptable Use

You agree to use the Service only for lawful purposes. Prohibited uses include:

• Sending unsolicited fax advertisements or spam in violation of the TCPA.
• Transmitting unlawful, threatening, or defamatory material.
• Infringing on third-party intellectual property or privacy rights.
• Attempting unauthorized access to the Service or connected systems.
• Interfering with or disrupting the Service.
• Reselling or redistributing the Service without written consent.

8. HIPAA and Healthcare Users

If you need to send or receive faxes containing Protected Health Information (PHI), you must subscribe to a HIPAA-eligible plan and execute a Business Associate Agreement (BAA). Transmitting PHI without a signed BAA is a violation of these Terms.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that all faxes will be delivered successfully.

10. Limitation of Liability

To the maximum extent permitted by applicable law, our total aggregate liability shall not exceed the total amount you paid to us in the twelve (12) months preceding the event giving rise to the claim, or one hundred US dollars ($100), whichever is greater.

11. Governing Law

These Terms shall be governed by the laws of the State of Delaware, United States. Any dispute shall first be attempted to be resolved through good-faith negotiation, then binding arbitration administered by the AAA.
